NOTICE TO ONLINE ENTRANTS

In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person (18 or older) who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsors and Promotion Parties (as defined below) are not responsible for: (i) lost, late, misdirected, damaged, illegible or postage due mail/entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsors on account of technical problems or traffic congestion on the Internet or at any web site, computer/program incompatibility or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Sweepstakes. By participating in the Sweepstakes, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsors and the independent judging organization, which are final and binding in all matters relating to the Sweepstakes.  Failure to comply with these Official Rules may result in disqualification from the Sweepstakes.  The Sponsors reserve the right to: (i) permanently disqualify from any Sweepstakes they sponsor any person they believes have intentionally violated these Official Rules; and (ii) withdraw the online method of entry if it becomes technically corrupted, (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Sweepstakes), and to select the winners from among all eligible mail-in entries and all eligible online entries received prior to withdrawal.

The Dragonball Evolution Sweepstakes (“Sweepstakes”) begins at 12:00 P.M. Eastern Time (“ET”) on March 5, 2009 and ends at 11:59 A.M. ET on April 9, 2009 (“Sweepstakes Entry Period”).  All information gathered in conjunction with this Sweepstakes will be solely for the purposes of the Sweepstakes.  All information (e-mail addresses, etc.) will be destroyed after the Sweepstakes is completed and winners are verified.

Eligibility: The Sweepstakes is open to legal residents of the 50 United States including the District of Columbia who are between the ages of 7 and 15 at time of entry. Employees of Sports Illustrated KIDS, a Division of Time Inc. and 20th Century Fox Corporation (the “Sponsors”), their respective parent company, subsidiaries, affiliates, advertising and promotion agencies, prize suppliers and any other individual or company involved in the development or execution of the Sweepstakes (“Promotion Parties”), and members of their immediate families (parent, child, sibling and their respective spouses) and same households of each, whether or not related, are not eligible to enter or win. Sweepstakes is subject to all applicable federal, state, local laws and regulations.  Void where prohibited by law. 

How to Enter: There are two ways to enter. Method #1: To enter online, visit www.sikids.com/dragonball and follow instructions to search the photo galleries at www.sikids.com/photos to locate the specified number of hidden dragonball(s). At the Sponsors’ sole discretion, the number of dragonball(s) may change each week.  Once you have found the specified number of dragonball(s), complete the Entry Page including your first name, email address and check-off the multiple choice check box of all the locations where you found a dragonball.  Upon completing the Entry Form, press the submit button to enter for a chance to win. Only complete and valid entries as determined by the Sponsors will be eligible for entry into the Sweepstakes Drawing.  Limit one (1) online entry per person or e-mail address per day regardless if entrant has more than one email address or if more than one person uses the same email address. Although subsequent attempts to enter on a given day may be received, only the first entry received from a particular individual email account will be eligible; subsequent attempts to enter in a given day will be disqualified. Entrants subject to all notices posted online including but not limited to Sponsors’ privacy policies. To enter without providing the location(s) of the dragonball(s), see Method #2. Method #2: To enter via U.S. mail, print your name and address on a postcard and mail to: Dragonball Evolution Sweepstakes, c/o: Sports Illustrated KIDS, 1271 Avenue of the Americas – RM 33-316B, New York, NY 10020. Mail-in entries must be postmarked between March 5, 2009 and April 9, 2009 and received by April 16, 2009. Each postcard entry must be mailed separately.  Sponsors and Promotion Parties are not responsible for lost, late, damaged, illegible, garbled, inaccurate, invalid, mutilated, misdirected, undelivered, delayed or postage due mail/entries. No photocopied or mechanically reproduced, altered or incomplete entries will be accepted. All entries, regardless of entry method, become the Sponsors’ property and will not be returned or acknowledged.

CONSUMER DISCLOSURES: No purchase necessary. You have not yet won. Many will enter. Few will win. Prizes and their Approximate Retail Values ("ARV"): One (1) Grand Prize: Grand Prize Winner and up-to 50 of his or her friends (max. of 52 people) will receive aprivate movie screening of Dragonball Evolution (ARV: $600) plus a Dragonball Battle Robe (ARV: $19.95) (ARV of Grand Prize: $619.95). Six (6) Second Prize Winners: Dragonball Battle Robe (ARV: $19.95 each). Approximate retail value of all prizes $739.65. Odds of winning depend on number of eligible entries received, estimated at 1: 10,000 for Grand Prize and 1:1,667 for a Second Prize.

For the Grand Prize Winner: The screening of Dragonball Evolution (“movie screening”) is strictly limited to no more than 52 seats in a commercial theatre to be selected at the sole discretion of Sponsors who will make its best efforts to set the screening in a theatre within 10 miles of the Grand Prize winner’s home.  The date and time of the movie screening will be at the Sponsors’ sole discretion and will be shared with the Grand Prize winner at a later date.  If the Grand Prize winner cannot see the film between the above dates or as mandated by the Sponsors, the prize is forfeited and a substitute prize for the movie screening will not be awarded. Movie screening is not exchangeable for cash or another movie title. If the movie screening is canceled or postponed (for any reason whatsoever), no compensation or substitution will be provided for the screening portion of prize, however, the remainder of Grand Prize will be awarded.  The movie screening does not include any meals, beverages, ground transportation, parking,  taxes, gratuities, incidentals, service charges or other expenses not specified herein are the sole responsible for the Grand Prize Winner and his/her guests. A parent or legal guardian will need to accompany each invited minor to the location where movie screening will take place and will be required to complete and return (to Sponsors) a guest release form prior to the date of the movie screening. Sponsors and/or the movie screening location personnel reserve the right in their sole discretion to suspend or cancel the Grand Prize Winner’s and/or his/her guests’ attendance at the movie screening due to non-compliance with any security procedure or inappropriate behavior or misconduct.

Winner Selection and Notification: All eligible entries received during the Sweepstakes Entry Period will be included into the random drawing. All winners will be determined via a random drawing conducted by Ventura Associates, Inc., an independent judging organization whose decisions are final and binding.  Random drawing will be conducted on or about April 28, 2009. All prizes will be awarded in the name of each winner’s parent or legal guardian. The parent or legal guardian of the Grand Prize Winner will be required to execute and return an Affidavit of Eligibility/Liability and a Publicity Release (“Prize Notification Documents”) on behalf of potential winner. If a potential winner entered this Sweepstakes via Method #1 (online entry), he/she will be notified once via email with instructions for potential winner’s parent or legal guardian to respond with the potential winner’s primary residence address (street addresses only – no P.O. Boxes) in order to mail the Prize Notification Documents. If a parent or legal guardian’s email address was provided on the entry form, three attempts will be made to contact the potential winner’s parent or legal guardian within a 7 day period. If the potential winner’s parent or legal guardian fails to respond within that period, or if the e-mail attempt is returned as undeliverable more than one time, the potential winner will be disqualified and an alternate winner will be selected at random. (Entrants and/or their parents or legal guardians are responsible for notifying Sponsors of changes in e-mail addresses.) Should a potential winner’s parent or legal guardian fail to respond within the required period, or fails to execute and return required documents, an alternate winner will be selected at random. When the potential winner’s parent or legal guardian’s mailing address has been obtained, he/she will be notified via Federal Express delivery. Pre-paid Federal Express envelope will be provided. Grand Prize Winner’s parent or legal guardian will be required to complete and return required documents, which must be signed and returned within 10 days of date printed on notification or an alternate winner will be selected at random. Should a potential winner’s parent or legal guardian fail to respond within the required period, or fails to execute and return any required document(s), or if a prize notification or prize is returned as undeliverable, or if a potential winner cannot accept or receive the prize for any reason, or if he/she is not in compliance with these Official Rules, the corresponding prize will be forfeited and an alternate winner selected. Prizes awarded within 30 days after receipt and verification of each winner. Prizes are not redeemable for cash. Winners may not substitute or transfer prize.  Sponsors reserve the right to substitute prize with one of equal value in the event the offered prize becomes unavailable. The Grand Prize Winner’s parent or legal guardian will be responsible for payment of all applicable federal, state local and income taxes associated with winning the Grand Prize. Entry and acceptance of prize constitutes permission to use each winner's name, prize won, hometown and likeness for purposes of advertising, promotion and publicity in any and all media(including online posting) without additional compensation, notification or permission. Prizes are guaranteed to be awarded.

Releases: Participating entrants agree to abide by these Official Rules and the decisions of the judges which are final and release the Sponsors, Promotion Parties and any other businesses involved in this Sweepstakes as well as the employees, officers, directors and agents of each, from all claims and liability relating to their participation, acceptance, use or misuse of any prize.  Sponsors are not responsible if Sweepstakes cannot take place or if any prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism. Winners and their parents or legal guardians assume all liability for any injury or damage caused or claimed to be caused, by participation in this Sweepstakes or use or redemption of prize. Sponsors are not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of prizes.

Arbitration: This Sweepstakes shall be governed by and interpreted under the laws of the State of New York, U.S.A. without regard to its conflicts of laws provisions. By participating, entrants agree that any and all disputes arising out of or relating in any way to this Sweepstakes shall be litigated only in courts sitting in New York, NY, U.S.A.
